Welcome to Pomi. By using our service, you agree to these Terms. Please read them carefully. Pomi is an AI companion designed to provide emotional support — not a replacement for professional mental health care.
1. Acceptance of Terms
By accessing or using Pomi (the "Service"), provided by MyPomi Inc. ("we," "us," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or via email. Your continued use after changes take effect constitutes acceptance of the updated Terms.
2. Service Description
Pomi is an AI-powered emotional companion that provides:
- Conversational emotional support and companionship
- A private, non-judgmental space for self-expression
- Conversation continuity through persistent memory
3. AI Disclosure
Pomi is an artificial intelligence. Pomi is not a human, not a licensed therapist, psychologist, psychiatrist, or medical professional of any kind. Pomi does not provide medical advice, diagnosis, or treatment.
In compliance with California SB 243 and New York General Business Law Article 47 (AI Companion Models):
- All interactions with Pomi are with an AI system
- Pomi is clearly identified as an AI companion throughout the app, including a persistent notice in the chat interface
- Pomi's responses are generated by machine learning models and may not always be accurate or appropriate
4. Not a Substitute for Professional Care
If you are in crisis or experiencing a mental health emergency:
- United States: Call or text 988 (Suicide & Crisis Lifeline)
- Canada: Call 1-833-456-4566 (Talk Suicide Canada)
- Emergency: Call 911
Pomi is designed for emotional support and companionship only. It is not a substitute for:
- Professional therapy or counseling
- Psychiatric evaluation or treatment
- Crisis intervention services
- Medical diagnosis or treatment of any kind
You should not rely on Pomi for decisions regarding your health, safety, or well-being. Always consult a qualified professional for medical or mental health concerns.
5. Eligibility
You must be at least 18 years of age to use Pomi. By using the Service, you represent and warrant that you meet this age requirement. We do not knowingly provide services to anyone under 18.
6. Your Account
- You sign in using Google or Sign in with Apple. You are responsible for maintaining the security of the account you use to sign in.
- You are responsible for all activity that occurs under your account.
- You may not share your account with others or allow others to access Pomi through your account.
- You may delete your account at any time from within the Pomi app (Settings → Delete Account), or by contacting us at contact@mypomi.ai.
7. Acceptable Use
You agree not to use Pomi to:
- Violate any applicable law or regulation
- Attempt to extract, reverse-engineer, or manipulate the AI system
- Generate content that promotes violence, hatred, or illegal activity
- Impersonate another person or misrepresent your identity
- Interfere with or disrupt the Service or its infrastructure
- Use the Service for any commercial purpose without our permission
We reserve the right to suspend or terminate your access if you violate these terms.
8. Subscriptions & Payments
Pomi may offer paid subscription plans. During the current testing period, all features are free of charge; official pricing will be announced before launch. If you subscribe:
- Payments are processed securely by the Apple App Store and Google Play through in-app purchase. We never receive or store your payment card information.
- Subscriptions renew automatically unless cancelled before the renewal date.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds for in-app purchases are handled through the Apple App Store or Google Play refund process. Please submit refund requests through the platform where you purchased; if you need help, contact contact@mypomi.ai and we will assist you.
9. Privacy & Data
Your privacy is fundamental to Pomi. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key points:
- We never sell your data
- We never use your conversations for advertising
- Your conversation data is treated as sensitive personal information
- You have the right to request deletion of your data at any time
10. Intellectual Property
All content, features, and functionality of the Service (including but not limited to text, graphics, logos, and software) are owned by MyPomi Inc. and are protected by intellectual property laws.
Your conversations with Pomi are your own. We do not claim ownership of the content you create through the Service.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind.
- We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Specifically, we are not liable for any decisions you make based on conversations with Pomi, including decisions related to your health, relationships, career, or finances.
Mandatory rights preserved: Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under the mandatory laws of your country or state of residence (for example, liability for death or personal injury caused by negligence, or non-waivable consumer protection rights). The limitations above apply only to the extent permitted by those laws.
12. Indemnification
You agree to indemnify and hold harmless MyPomi Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account data in accordance with our Privacy Policy
- Provisions that by their nature should survive termination will survive (including Limitation of Liability, Indemnification, and Governing Law)
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware.
Your local consumer rights still apply. Nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your country or state of residence. To the extent those mandatory laws conflict with this section, they prevail, and you may have the right to bring proceedings in your local courts where such laws so provide.
15. Dispute Resolution
Before filing any legal claim, you agree to first contact us at contact@mypomi.ai and attempt to resolve the dispute informally for at least 30 days. If informal resolution fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
If you are a consumer, the arbitration requirement above applies only to the extent permitted by the mandatory laws of your country or state of residence. Where those laws prohibit mandatory arbitration or preserve your right to bring a claim in your local courts, that right is not waived.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
